How do I pay for your services?

Personal injury attorneys customarily get paid a percentage of the money recovered called a contingent fee.   This means, if you retain our services we do not charge you anything unless we collect money for you through a settlement or judgment.  Our fee is then a percentage of the settlement or judgment.  If we do not collect money on your behalf, we do not collect a fee.  Most of the time, we will pay for all of the expenses that are involved in building your case. If you receive money as a result of a successful settlement or judgment, we will be reimbursed our expenses at that time from your proceeds.

How much is my case worth?

This is probably the most frequently asked question.  Each case is different and there are no rules for valuing a case.  Some of the factors that influence a cases value are the severity of the injury and whether it impacts on your ability to earn a living, the question of liability or fault, the amount of available insurance coverage, the permanency of your injuries, and other contributing factors.  Your attorney may be able to give you a very general idea of the value of your case based on prior similar injuries, but usually cannot predict a specific recovery. Reputable attorneys will not speculate on the value of a case or promise a specific result.

How long will my case take?

Every case is different. Some cases can be settled promptly while others take years to resolve. A number of factors influence how long a case will take.  For example, a more severe injury may take longer to stabilize and therefore, it may take more time to determine the full extent of injuries.  Conversely, some cases can be resolved in a quicker time frame.  While fast results are desirable, remember that you do not want to hurry or rush your case as your financial recovery will be better if the case is handled in a thorough manner.

An insurance adjuster wants to settle and says I do not need lawyer. Should I get one?

Remember, the adjuster works for the insurance company.  The adjuster has one goal...  to settle your case for the least amount of money possible. What may seem like a fair offer to you could fall far short of the amount of money received in a personal injury settlement through a lawyer.  Do not count on the adjuster or the insurance company to look out for your best interests. Hire an experienced personal injury attorney.

What Is uninsured motorist coverage? What is underinsured motorist coverage?

This is the most important insurance for any driver in Florida to have.

Uninsured motorist coverage protects you if you are injured as a result of an automobile accident with a vehicle that has no insurance coverage. This can occur if an owner did not pay insurance premiums, if a car is stolen, or in a "hit and run" accident. In an uninsured motorist situation you can recover monetary damage for your pain and suffering from your own automobile insurance company if you have this coverage.

Underinsured motorist coverage applies if the injuries you sustain are greater than the insurance coverage on the vehicle that caused your injuries.  For example, if the value of your case is $100,000.00 and the vehicle which caused your accident is only insured for $10,000.00 you can make a claim against your underinsured motorist coverage for the additional amount assuming you have sufficient underinsured coverage on your vehicle.

Not all automobile insurance policies contain uninsured or underinsured motorist coverage, but everyone should have it.
